Attorney Fee Structures

Structuring Attorney Fees: Language to Use in a Settlement Agreement

Structuring attorney fees has benefits: better money management of future expenses such as a child's education or your retirement, possibly lowering your tax bracket, guaranteed payments, and, as with injured-party settlements, receiving more money than if you had taken an initial lump sum payment.

U.S. Treasuries Provide Diversification to Structured Settlements

Not all structured settlements begin and end with a life insurance annuity. A number of investment options are available when creating a structured settlement to meet an injured party's financial needs.

Tax-Deferred Attorney Fees–Part of End-of-Year (or Year-Round) Tax Planning?

The end of the year usually means a last-minute scramble to reduce taxable income. Pushing income into 2011 will provide temporary tax relief but another option could provide even longer-term tax benefits: creating tax-deferred fee structures with payments (and thus taxes) paid over time.

Structuring Fees: The Latest Financial Planning Technique?

Although structured attorney fees do not have all the tax advantages of structured settlements for plaintiffs, there are still elements that make them attractive. Attorneys began using structured payments for legal fees in physical injury or sickness cases after the decision in Childs vs. Commissioner, 103 T.C. 634 (1994), affirmed 898 F3d 856 (1996). The Tax Court held that attorney fees from these types of cases could be received in periodic payments.

Structuring Attorneys Fees – The Fine Print

Great Expectations From Your Structured Settlement Broker [Litigation Commentary & Review – Jan/Feb – 2010]

Structured settlement broker services are client driven. Brokers should be available whenever attorneys or their clients need them, even if it is after hours and on weekends. There is no cost to either side--plaintiff or defense. This works to the advantage of all parties. Attorneys should use brokers to the fullest and expect them to work as hard on a case settlement as they do.

Structured Settlements Offer Clients Financial Security

Clients choosing cash settlements assume the risks associated with their investments during both stable and volatile economic times. Clients requiring lifetime care and support usually do not have the luxury of being able to weather market ups and downs and fluctuating incomes, especially when unforeseen medical emergencies are part of life.
